Are you familiar with all of your district courts? Your district courts do not only deal with minor civil and criminal issues, there is a wide array of topics that they cover. For example, there is the probate court. The probate court performs many duties of other courts as well as their own. If somebody in your family has passed and there is a will to worry about, other district courts do not usually delve into these issues. The probate court exists for this reason as well as several others. Hopefully you will not need to use a probate court any time in the near future, but unforeseen circumstances do arise. When they do, it is a good idea to be prepared for anything. You should know which of the district courts you will be visiting and what exactly it is that they do. Here are some of the reasons why you may have to visit a probate court. District courts have plenty of purposes, so hopefully this information can provide some clarification.

1. Wills – The probate court deals with taking the will of a recently deceased person and making sure that their assets are distributed to the people named in the actual will. Aside from distribution, these district courts will also make sure that the will provided is legal. If everything checks out and has been done properly, the probate court then goes ahead with the distribution of the assets. District courts such as this one are very important to families that have recently experienced a loss.

2. Deceased without a valid will – If somebody has passed but never put together a valid will, the probate court will handle that issue as well. Since there are laws put into place for situations just like this, these district courts take on the responsibility of splitting the assets and estate evenly among the legal beneficiaries.

3. Family – Not every probate court will deal with these issues but there are several of these district courts that will perform the duties of a family court. Issues such as marriages and adoptions are handled by the probate court, which is not something every one of the other district courts deal with. If in the future you ever think about adopting a child, it is very possible that you will be visiting this type of court.

4. Name – These courts are also visited if somebody would like to legally change their name. Having to go to court may seem a bit excessive, but that is just how things work.

5. Guardianship – This is another situation where a probate court would be used. Sometimes there are a series of events that lead to somebody having to become a juvenile’s guardian. Hopefully this reason is not because of a tragedy, but they do happen.

Learning about all the different types of courts will be very valuable to you at some point in your life. Keep reading and expand your knowledge base.

Sometimes things come up and we can’t make it to the court dates chosen by the court itself. There are unavoidable circumstances that may arise, such as family emergencies, health problems, or something else of that nature. One thing that can be of great assistance to you when this type of problem arises is the use of dockets. Court dates can be changed, they are not set in stone. Dockets are basically calendars which will show the viewer what cases or hearings are coming up in the near future. This way, when court dates are inconvenient for people, they can check these dockets to find a date that would better suit their own schedule. Here are some Do’s and Don’ts for changing court dates. Dockets are there for public viewing, but there are some rules you should follow.

DO make sure that if your court dates need to be changed, you contact the court at least two weeks beforehand. Look through the court’s dockets to see what times are available before you actually get in contact with them. Not knowing when you are available will just be a waste of time. Obviously in medical emergencies some exceptions can be made. Otherwise, do not take a chance. You do not want to get on anyone’s bad side if you are getting ready to go to court.

DO NOT try to do this more than once. The people running a court are understanding individuals. If there is a problem with the court dates they have sent you, get on the dockets and find another one. Most courts will not let you do this more than once though. So if you’re thinking about trying to take advantage of the system and asking for multiple changes to your court dates, just don’t. Dockets are not there to be abused, and you do not want to be in any more trouble than you are already in.

DO use the Internet to find dockets for your local court. Many courts have put their dockets up online for the public to browse through. If people need to change their court dates, they can simply use a search engine to find their local court’s calendar. All the other court dates will be listed on there.

DO NOT contact the court without a legitimate excuse! If you try changing your court dates because you just don’t feel like going to court that day or your favorite television show is on, you are going to get laughed at, then fined or worse. Our judicial system is not a joke or a game and they will not appreciate it if you attempt to treat them as one. Use the dockets available to you only if you have a real problem.

It is possible that somebody has an actual problem and needs to change the date of their court appearance, it happens all the time. Don’t make other people look bad by abusing the system.

Children make mistakes. Making mistakes is a part of growing up, and it is necessary for the youth of this country to learn from them and grow as people. That is the reason why when a juvenile commits a crime, they are taken to juvenile court instead of an adult district court. As adults, we should know how to act properly in most given situations. The younger generations do not have the luxury of experience and knowledge, and they must learn by doing. Unfortunately, sometimes they make the decision that will get them into trouble. If you do not have a lot of information about the juvenile court system, it can be beneficial to you, especially if you have children of your own. The readers on here are most likely adults, but in case there are some younger people reading, it would be a good idea for you to gain some knowledge about your juvenile district court as well. Here is some juvenile court information to start you off so that you’ll know everything you need to about this district court.

1. Juvenile court can also be called young offender court. If you have ever heard this term referring to a district court, you can now be positive that they are referring to a juvenile court. Believe it or not, many people have actually been confused about this in the past. Clarification seemed necessary since there are people out there that think young offender court is a separate district court.

2. Although for most states the age where a juvenile is considered an adult is eighteen, there are some exceptions. You might be in an area where an eighteen year old would still be going to a juvenile court. For example, in the state of Alabama, somebody would be eligible to have their case held at a juvenile district court.

3. For severe crimes, it is very possible that instead of juvenile court, the youth will be moved an adult district court. While juvenile court is in place because children do make mistakes, there is an extent to the leniency provided. If a child or teenager is committing murder, there is no choice but to send them to an adult district court.

4. The juvenile court has not actually been around for that long of a time. Before the late 1800′s, everyone went to the same district court. Thankfully, our society has recognized that children are not as responsible as adults, and that is when the juvenile court came into existence.

Aside from murder and other sever crimes, the youth offender court has helped rehabilitate many of younger generation. I am glad that the society we live in has seen the need for a separate district court and has acted upon it. Children are like clay, they need to be molded into model citizens. Taking your clay and putting it away if it doesn’t take the shape you intended it to is not the way to fix the problem. You just need to try a different method.

Have you ever needed to visit county courts? If you ever did have to visit one, would you know which court district you would be in? Many people do not have this knowledge, but it is valuable information to have. Knowing what court district you are in should be a piece of basic knowledge that everyone possesses. Our legal system is in place for our own benefit, and we need to make sure that we know something as simple as which one of the many county courts we would have to visit should that time ever come. Hopefully none of you will ever need to set foot in the county courts, nobody ever likes to take time out of their day to go to court, even if it is for a civic duty such as being part of a jury. Unfortunately for many of us, having to go to court is inevitable so we want to know our court district. Here is some information that might help you.

1. A court district can actually cover several counties. Every county does not necessarily have their own personal county courts. If you live in an area with a lower population compared to other counties, it is very possible that your court district will constitute not only your county but a number of surrounding counties as well. County courts are meant to be local courts, but sometimes you may have to travel a bit.

2. County courts are different than city courts, even if that city is technically a part of the county. The city will usually have their own court district since the high population calls for it. Places like New York City have five county courts, one for each borough. This is a rare occurrence but is necessary because New York City’s population is extremely high. Each borough acts as their own court district, and it would be unrealistic to change their methods.

3. Although county courts do not handle all types of cases, they are prepared to deal with several different issues. They can deal with small claims disputes, civil disputes, and criminal cases. Something like a bankruptcy issue though, a county court district will not have the jurisdiction to handle. These must go to the state court level by American law, and county courts are not allowed to touch them. There are plenty of issues handled in your local court district, so that is not that big of a deal.

Knowing about your local county courts will never hurt you in any way. If you have never even set foot inside of a court, visiting a local court near you can actually be an interesting experience. Just sit yourself in a chair, log onto the Internet, and find out what court district you are in. Then use that information to find the nearest courthouse and go down there to check things out. Seeing the hustle and bustle of our judicial system can be memorable for you.

Obviously many of us do not have an abundance of free time on our hands. Most of us have to work for a living and during the few moments we actually do have some free time, we want to relax. Nothing can eat up our moments of leisure like having to go to court, whether it is because of a traffic incident, civil dispute, or criminal activity. Checking a court docket for your local court can be a very good way to save yourself that valuable free time that we all covet. Dockets are available for the public so that they can see what hearings have been scheduled in a court and when. If you ever get a chance to choose the day you visit court, make sure to check a court docket to see when both the court and yourself are available. Checking dockets will give you assurance that nobody is pulling a fast one over on you and misrepresenting their times of availability. Here are some Do’s and Dont’s for browsing through a court docket. You may never have thought about it, but dockets can be a useful tool.

DO check a court docket to make sure you have the correct date for your hearing. Nothing looks worse than showing up late or not showing up at all. You do not want to get on a judge’s bad side, ever. The dockets are there so that these misunderstandings do not occur. If the court date you received and the date for your hearing in the court docket do not match, contact the court to see what is happening. These dockets will minimize any possible confusion, which is a good thing for you and the court itself.

DO look through a court docket if you have never seen our legal system in process. It can be a memorable experience and will expose you to something new. Go through the dockets and find a case or hearing that looks interesting to you. Once you find something on the court docket, and you find out if the hearing is open to the public, go ahead and go there to check it out. Even if there is no hearing on the dockets that are open to the public, it might be fun to go down to your local courthouse to have a look around.

DO NOT use a court docket to look for people you know. Having to go to court can be embarrassing and frustrating for many of us. Nobody needs someone using the public dockets to come and harass them during a difficult time. If you do this, not only will you probably be making an enemy for life, you may be getting into some trouble yourself. A court docket is for public use and many people can use them to see a case they have some interest in, but the dockets are not there for stalking purposes.

Go online and look at a court docket. Dockets are there for you to view.

Important court decisions can be looked up in the court records that are kept diligently throughout the history of the United States. Important court decisions are made time and time again throughout the course of our lives. These court records show what court decisions were made and how they impact the current day as well as future of our lives.

Court records show that some of the most important court decisions made have to do with the issue of discrimination. Court decisions go through a lot of speculation and scrutiny over a long length of time to reach its conclusion. One of the most heavily impacting court decisions that show up in the court records would be when the Supreme Court of the United States voted that Caucasian firefighters residing in New Haven, Connecticut were unjustly treated by not giving them promotions due to their race. Court records show that the court decisions that were made for this situation could have affected the way employment was handled all throughout the country. Court records show that the Caucasian firefighters asserted that they didn’t acquire a promotion even though they were more than fit for them because the minorities had low scores. The court decisions for this case were reached on the 29th of June, 2009. Court records show another instance where important court decisions were made on the 25th of June, 2009. Court records show that this was brought about because a thirteen year old teenager was violated by being strip searched for her prescription ibuprofen. Court records show that the court decisions ruled in her favor by majority because it was irrational to go to that extent with this poor girl.

Court records also show that important court decisions were made pertaining to special education. On the 22nd of June, 2009, the Supreme Court came to conclusive court decisions that parents would not be required to send their challenged students to the public school system before applying for recompense for tuition of attending a private school. Another important set of court decisions that is shown within court records is the one pertaining to the Voting Rights Act. These court decisions were also made on the 22nd of June, 2009. Majority ruled in these court decisions to make it more difficult for discrimination to occur during voting periods. For the states that have had a past incorporating discrimination they would need to maintain approval if they were to change any portion of the way their elections are run.

Court records are easily maintainable even by simply searching the different cases in which you are looking for over the internet. Looking into what different types of court decisions were made can help you to learn about how the United States came to be the way that it is today.

A court docket is a record that contains basic information about a court case. The court docket typically includes the number of the case or docket, along with information regarding the court, attorney, judge, etc. Court dockets may also include a summary of court documents and other pertinent case events.

Online websites and databases have the large majority of court dockets on record. There is a system named “PACER” that maintains records for all federal court cases, yet it does not have its own website. A simple and quick search on the Internet may procure a few websites that offer access to dockets. State and county dockets are tougher to get your hands on, but not impossible.

It may be on your mind to find a county court docket to be able to review the records of the case or keep the records for future reference. For some, obtaining a copy of a county court docket might seem like a daunting task at first glance. Where do you start looking? What are some things that you should be looking for? How can you find a docket search to obtain a docket for your own records or review? Fortunately, there are court docket searches that have access to all types of dockets, whether it be at a federal, state, or county level.

You can follow these steps and advice to make your search a stress-free one:

1. Find your case/docket number

All county docket searches will require you to enter your case/docket number, along with some sort of verification to obtain a court docket. Prepare this number and relevant identification before you make your search.

2. Open a search engine and find a county docket search website.

Use Google to find the website that has access to your county docket. Some websites will charge you a fee, but there is likely a free docket search that has records of the county court you are looking for. As there are a large number of docket searches, be as specific as you can in your search query.

3. Browse to find the right county docket section and enter your case/docket number.

There will be differentiation between Supreme Court, federal, state, and local court dockets. Find the section for your county and enter your case number. If there are any additional verification requirements, complete them. You should be able to obtain the county docket you were looking for!

4. Store the county docket that you have just obtained.

You should keep the county docket in your files for future reference. There may be pertinent information there in the future!

tips:

- You may be able to find your local county’s docket database through a direct Google search. There are many counties around the nation that offer local county docket databases specific to their county.
- Federal and Supreme Court dockets are considered a branch of public records. Internet searches for your county’s dockets should be quick and painless.

Divorce rates are higher than ever in the United States. Recent statistics show that around half of marriages end up in a divorce. You may watch Divorce Court on the TV and realize that maybe you don’t love your spouse the way that you used to. If you should decide to go through with a divorce, going through the municipal court and red tape may seem a little bit daunting. A large percentage of the population deals with a divorce, but that does not mean that the process is simple, or easy.

Dealing with municipal court is enough trouble in its own right. While many have seen the Divorce Court TV show, countless others have not dealt with a municipal court. It is through the municipal court that the majority of citizens first experience the judiciary system. Municipal courts, however, are a necessary cog in the process of divorce. The divorce court determines the terms of the divorce, with special consideration to prenuptial and post nuptial agreements. Since divorce court hearings happen in a municipal court, many people will turn to lawyers to better help them understand their options.

Divorce court can cause a lot of unwanted stress, but there are steps you can take to better your experience and avoid as much headache as possible. Listed are some steps and tips that you can keep notice of to help you with your divorce and municipal court experience:

1. First decide whether or not you really do want a divorce.

A divorce is a painful experience that affects everybody involved. Make sure that you are certain about your decision. Consider counseling before turning to the divorce court. Unfortunately, the statistics work are against you.

2. Consult an attorney to help you with the divorce process

If you do decide to go through with the divorce, there is a complicated process in front of you. Find an attorney to help guide you through the process. Each state has different divorce laws, and there may be particularities to your situation or location that an attorney can help you with through consultation. They will guide you through the divorce process and the municipal court.

3. Visit your local municipal court’s family law department.

The family law department at your municipal court is where you make your initial divorce petition for divorce

4. Gather your financial and asset information

The biggest disagreement in a divorce is usually about how the two parties will split assets, including money, property, goods, and even custody of children. The first step before attending divorce court is to gather all of your relevant information including tax returns, credit card bills (along with other financial credit information), and retirement accounts.

4. Go to your divorce court hearing.

Your municipal court is where you make your case in front of a judge. It is still a court of law, so make sure to consult with your attorney about proper behavior and etiquette. After all, the angry one always loses the case in Divorce Court. After reviewing the evidence and the arguments, the judge will make a decision that he or she thinks is fair.

5. Sign the final decree of divorce paper.

After you sign this paper, you are officially divorced.

Bankruptcy Court

Declaring bankruptcy may scare most people but sometimes there is no other option. Credit card companies will chase you all the way to bankruptcy court. Fortunately, bankruptcy court is a federal court given to us as protection. Bankruptcy court just might be the best gateway to start over. Although bankruptcy can stay on a credit report for up to 10 years or hurt your future job search, it may help you start over with your credit.

Each bankruptcy court is a federal court that deals with bankruptcy cases and matters. There are 94 federal courts that comprise the judiciary branch of government. Each federal court is split into one of three categories. General trial federal courts, federal courts with appellate jurisdiction, and the federal court of last resort (Supreme Court). Therefore, your local federal court also doubles as your bankruptcy court.

Before you go to bankruptcy court, however, you must obtain credit counseling from an entity approved by the U.S. Trustee within 180 days of filing your case. This is due to the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (“BAPCPA”), which heavily amended the workings of the bankruptcy court.

So if you decide you need to file bankruptcy in order to save your financial future, what should you do and what should you be aware of? Here are some steps that you can follow to make your bankruptcy as painless as possible:

1. Determine whether or not it is necessary for you to file for bankruptcy.

Avoiding federal court is almost always a good idea. Bankruptcy can cripple you financially for up to 10 years. Do everything you can to make sure you are not at your last option. Going to bankruptcy court will also accrue expensive fees, including court, application, and lawyer fees.

2. If you choose to file for bankruptcy, review your options with the consultation of a lawyer.

Many people file bankruptcy without a lawyer. There are many factors to consider, however, when dealing with bankruptcy court. For example, bankruptcy court requires that you file as one of two types of bankruptcy. There is the chapter 7 (liquidation bankruptcy) and the chapter 13 (repayment plan) bankruptcy. Ask your lawyer which one fits you the best.

3. Meet with a credit counselor.

Now, when an individual files for bankruptcy, the BAPCPA requires him or her to meet with a credit counselor within 180 days of bankruptcy filing. Be completely honest with the counselor, as he or she holds the power to deny your bankruptcy claim. You will be sworn in after a 10 minute meeting.

Tips:

-You may not be able to avoid paying tax bills or student loans. Be prepared for this. It depends on certain Bankruptcy Code provisions and how well your creditors convinced the judge that you should still pay those debts.
-Only creditors will find out about your trip to the bankruptcy court. Be honest about your bankruptcy though, as anybody can find the truth.
-When you enter a federal court, make sure you are prepared and respectful. Federal courts are the courts with the highest authority.

Family Court

Family court is the court that gathers to decide issues and create orders for family law. Family court deals with family issues such as custody of children, abused or neglected children, adoption, paternity, guardianship, and child support. For example, if you have a divorce with your spouse of 20 years and are fighting over the custody of your children, you would likely go to family court to settle the issue. There are also family court lawyers that specialize in this type of law.

Unfortunately, things do not always go as planned. You may have experienced unfairness or believe that certain facts or laws were used in the wrong way. When you believe this to be true, no matter what court you are in, you should seek an appeals court. Often called a Court of Appeals, appeals court is a court with the authority to review errors in a case. They also often take cases from courts with less jurisdiction, to re-evaluate the legal procedures, facts, or evidence of a case.

So when would you turn to an appeals court when you are in family court? In most courts, you are allowed one appeal as a right. If the appeals court fails to find grounds for an appeal, that is, a legitimate reason for an appeal, the case will be dropped and you will lose a lot of money. So when and how can you appeal in family court? Here are some steps and tips to follow:

1. Ensure that you are making the right decision to appeal-

Are you sure that the risk/reward is worth it? Appeals court can be expensive, and there is no guarantee that you will get an appeal, let alone a judgment that you are satisfied with. Consult with a lawyer for advice.

2. Find a lawyer to work your appeals court case-

The lawyer that represented you in family court is required to start the appellate case for you. If you are found to qualify for “poor person relief,” the court may assign you a free lawyer.

3. Fill out your notice of appeal and serve the respondent-

Each case in the appeals court first requires a notice of appeal from you. You will need 2 copies of this notice to present to the family court that heard your case.

3. When you get to the appeals court, state your case and ground for appeal

Your lawyer will do the work here, obviously. You will receive one of the following decisions from the appeals court: reverse, remand, affirm, and/or modify. Reverse is when the appeals court decides that the family court was wrong. Remand is when the appeals court orders the family court to rehear the case. Affirm is when they deem the case ruled correctly. Modify is when the appeals court changes only a part of the decision.

Tips:

-Ensure that you make your court date. You will have to pass more red tape for the case to be reopened.
-Search for free lawyer consultation before you decide to appeal in family court.
